Terms and Conditions for Classes

These Terms form the basis of the contract between our customer and Piece of Cake by Clare.  These Terms, your Class Booking and your Class Booking confirmation are considered by us to set out the whole agreement between you and us for the sale of cake decorating classes. It is your responsibility to check all details on the invoice are complete and accurate as we are unable to provide refunds or accommodate date changes in the event of cancellation or non-attendance for any reason.

 

​Class Booking

  • Your booking is not confirmed nor fully booked until your class invoice has been paid.

  • By paying for the class to secure your booking, you are confirming your acceptance of our Terms and Conditions and details set out on the Invoice.

  • The price of your cake class will be as set out in your invoice.

  • The balance must be paid in cleared monies no later than the date set out in the invoice by bank transfer to the account specified.

  • If payment is not received by the date specified, we will assume that you are no longer interested in attending the class and will offer your place to those on the waitlist.

  • Please note all class fees are non-refundable. 

  • From time to time certain materials for our cakes and/or cake classes may become obsolete. This is totally out of our control; however we will do our best to select replacement products to reflect the original design and/or class content as closely as possible. We reserve the right to replace items with component parts of equal or better quality without consultation.

Gift Vouchers

  • Gift vouchers are available to purchase and are valid for 1 year from the date of purchase. 

  • Gift vouchers are non-refundable.

 

Allergies

  • Our cakes are made in an environment where nuts, egg, milk, gluten and other allergens are present. We cannot guarantee that any cake is entirely allergen free as cakes are baked in a home kitchen where allergens are present.

 

Storage and Transportation

  • The cake is a fresh product containing no additives or preservatives and it is our right to assume consumption on the day of the class. Cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat, in the box provided. They should NOT be refrigerated unless advised otherwise.

  • We accept no responsibility for any damage sustained to the cake once it has left the premises, including but not limited to, during transportation, set-up or any time thereafter.

  • Instructions on how to carry, transport, and store your cake are advised at the end of the class.  Keep in mind that cakes are very fragile and damages can happen if not handled properly. Piece of Cake by Clare accepts no responsibility for any damage sustained to the cake once it has left the premises.

Photography

  • You agree that images taken during the class may be shown on social media or on Piece of Cake by Clare's website.  These images are the property of Piece of Cake by Clare but please advise in writing to pieceofcakebyclare@hotmail.com if you'd prefer any names or images of people to be excluded from any marketing material. 

  • Please feel free to share any images you take during your class and tag Piece of Cake by Clare.

Cancellation, postponement and alterations

  • If you need to change the date of your class booking after the class fee has been paid, we will do our best to accommodate your request, otherwise no refund will be issued. 

  • If you are unable to attend and we are able to re-sell your place, your class fee will be refunded. 

  • In the unlikely event that we need to cancel your class, any monies paid will be refunded.

  • I require a minimum class size of two attendees to be booked in order to proceed with the class.  Therefore, I reserve the right to reschedule undersubscribed classes.  

  • Piece of Cake by Clare reserves the right to cancel, vary or suspend the operation of this contract if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies or any other event outside the control of Piece of Cake by Clare, and Piece of Cake by Clare shall not be liable for any breach of contract resulting from such an event.

 

Complaints 

  • Due to the amount of work put into each cake class we take complaints very seriously.  Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof, and providing the other party with a prior opportunity to resolve any issues between the parties amicably.

  • Any dissatisfaction regarding the class can sometimes be addressed at the time so errors of this nature must be pointed out so as to give us the opportunity to correct them. Any issues must be raised at the time before leaving Piece of Cake by Clare’s premises.

  • Where the complaint is in regards to the quality of the cake then the cake, or remainder of the cake/tier, must be returned to us as soon as possible after cutting and within 48 hours of the class to ensure that we are able to fairly assess the nature of the complaint.

  • Please note we can only deal with the attendee.

 

Waiver of Liability

  • Piece of Cake by Clare’s liability (both in contract and tort) in respect of defects in goods or services shall be limited to the issue of a credit note in respect thereof or granting a refund or other such compensatory measures as Piece of Cake by Clare, at its discretion, considers appropriate in the circumstances and shall be limited to the value of the goods or services giving rise to the claim.

  • Piece of Cake by Clare shall not under any circumstances be liable for any incidents or injuries which may occur whilst attending Piece of Cake by Clare’s classes, this includes damage to property, including vehicles or personal belongings.  Any property left on site is done so at your own risk.
